1. Acceptance of Terms
By accessing or using ShotCast ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not use the Service. These terms apply to all users, including photographers, event organizers, and guests who access event galleries.
2. Description of Service
ShotCast is a real-time event photography platform that enables photographers to upload, process, and distribute photos to event guests. The Service includes photo upload and storage, facial recognition matching, WhatsApp delivery, photo sales via PIX, and web-based gallery access.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate and complete information when creating an account. You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Content and Intellectual Property
You retain all ownership rights to photos you upload to ShotCast. By uploading content, you grant ShotCast a limited license to store, process, and distribute your photos as necessary to provide the Service. ShotCast does not claim ownership of your content. You are responsible for ensuring you have the right to upload and distribute the content you share through the Service.
5. Photo Sales and Payments
If you enable photo sales, you agree to set fair prices for your photos. Payments are processed through third-party payment providers (PIX via Asaas). ShotCast charges a platform fee on each transaction as specified in your plan. Withdrawal of funds is subject to the payment provider's terms and processing times.
6. Subscription Plans
ShotCast offers free and paid subscription plans with varying feature limits. Paid plans are billed monthly. You may cancel your subscription at any time. Refunds are handled on a case-by-case basis. Feature limits (events, photos, etc.) reset at the beginning of each billing cycle.
7. Prohibited Use
You may not use the Service to upload illegal, harmful, or offensive content. You may not attempt to reverse-engineer, decompile, or disassemble any part of the Service. You may not use the Service to distribute spam or malware. You may not interfere with or disrupt the Service or its infrastructure.
8. Limitation of Liability
ShotCast is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
9. Termination
We may suspend or terminate your access to the Service at any time for violation of these terms. Upon termination, your right to use the Service ceases immediately. You may request export of your data before account deletion.
